This is an action in debt, by appellant, for the use of L. W. Sholtey, against Thomas Crowe, sheriff of Ford county, and the sureties upon his official bond. The cause was twice tried by jury. The first trial resulted in a verdict for the plaintiff, which was set aside, and the last, in a judgment for the defendants, from which the plaintiff appeals. The declaration avers in substance that the defendant Crowe, as sheriff, illegally levied an execution issued out of the Circuit Court of McLean county against Otto Taylor and Mary Taylor, upon the goods and chattels of the usee plaintiff,…
