JONES, Justice.

This case presents an appeal and a cross appeal from an action to quiet title to certain realty situated in Covington County, Alabama. This opinion is directed toward the appeal, because the cross-appeal is rendered moot by our disposition of the appeal itself. In light of our disposition of this cause, a detailed recitation of the protracted procedural background is unnecessary.
