The defendant, in anger, seriously injured the prosecutor Theodore Pitts by striking him across the face, using his rifle as a club. The blow was of such force that the stock of the gun was' broken by the impact. Subject to possible restoration by plastic surgery, the disfigurement of Pitts’ face is permanent. Defendant was convicted of aggravated assault and battery. The jury well might have found him guilty of the more serious count of the indictment chargiiSg assault with intent to maim.
