In this case an owner sues a contractor for the return of money^paid to-him- on a building contract.

The petition alleges that Charles A. Junker transferred to the plaintiff a certain lot of ground in order to make the plaintiff the record owner of it so as-to let out a building contract and erect for account of said Junker a building which was thereafter to be retransferred to him in accordance with the Homestead plan; that in pursuance of said agreement, the plaintiff, on July 9th, 1915, made-a contract with Frederick Junker, builder, for the erection of a two…
