This action stems from a 1981 criminal conviction in Michigan state court for two counts of first degree murder. Petitioner-Appellant Giovanni Cipriano brought a federal petition for a writ of habeas corpus, raising seven issues after he was denied relief under a newly-adopted Michigan procedural default rule and his state court remedies were exhausted. The district court denied Cipriano’s habeas petition, but granted a certificate of appeala-bility on three of his claims.
