On May 25, 1950, the United States commenced this action against the Fogaleys alleging violations of § 4 of the Emergency Price Control Act of 1942, as amended, 50 U.S.C.A.Appendix, § 901 et seq., and of § 206(a) of the Housing and Rent Act of 1947, as amended, 50 U.S.C.A.Appendix, § 1881 et seq., and the Controlled Housing Rent Regulation, as amended, 12 F.R. 4331, 13 F.R. 1861, and seeking damages, injunc-tive relief; and an order of restitution; At the trial the United States announced that it would not seek recovery of damages.
