MEMORANDUM OPINION
READY, Chief Judge.
This is a diversity action in which Preferred Risk Mutual Insurance Company (Preferred Risk) seeks declaratory relief respecting its rights and liabilities under an automobile insurance policy it issued to Samuel A. Poole. Joined as defendants in the action, in addition to the named insured, are George William Cuts-hall, administrator of the estate of Vernon Jerome Lovelace, and the heirs at law and death beneficiaries of J.
