OPINION

BUSSEY, Judge:

Appellant, Larry James Gamble, hereinafter referred to as defendant, was charged and tried before a jury in a two-stage proceeding in the District Court, Tulsa County, Case No. CRF-74-2756, and convicted for the offense of Unlawful Possession of Controlled Drugs (Heroin) with Intent to Distribute, After Former Conviction of a Felony. Punishment was assessed by the jury at a term of thirty-five (35) years’ imprisonment.
