The jurisdiction of this court is based upon its general power as a court of equity. (Matter of Runk, 200 N. Y. 447, 460.) The question presented is whether this court should *366assume jurisdiction over this proceeding in view of the pendency of a similar proceeding in the Surrogate’s Court of Nassau county. The solution of such question depends upon the construction to be given to the statutory power for the removal of a testamentary trustee vested in the Surrogate’s Court.
