On December 10, 1923, the Farmers State Bank of Kathryn closed, and one Jensen, who was cashier of the bank was placed in charge as special deputy bank examiner.
On the 28th of January, 1924, the plaintiff L. R. Baird, as receiver petitioned the district court of Burleigh county for a blanket order levying an assessment against the Farmers State Bank of Kathryn, together with thirty-seven other banks, and on the 29th of January, 1924, Judge Charles M.
