DIETRICH, District Judge.
This is an action to recover a penalty for the violation of what is commonly known as the “Twenty-Eight Hour Law.” Act June 29, 1906, c. 8594, 34 Stat. 607 (U. S. Comp. St. Supp. 1907, p. 918). The salient facts alleged are that the defendant operates a line of railroad connecting with a line belonging to the Union Pacific Railroad Company at Green River, in the state of Wyoming, and extending westward to the town of Hunting! on, in the state of Oregon.
