Appeal from an order of the Supreme Court (Dier, J.), entered February 21, 1997 in Warren County, which granted motions by certain defendants for summary judgment dismissing the complaint against them.
In 1994, defendant Adirondack Community College (hereinafter ACC) undertook to replace the heating, ventilation and air conditioning (hereinafter HVAC) system in many of the buildings on its campus which is located on land owned by *747defendants Warren County and Washington County.
