Upon the foreclosure of a mortgage upon personalty an execution, for $110.50 was issued, returnable to the county court. The defendant interposed an affidavit of illegality, and the papers were returned to the county court for trial. At the next succeeding quarterly term of the court, which was more than ten days after the papers had been returned, the case was called, and there being no appearance for the defendant, the affidavit of illegality was dismissed.
