This is a three count action for unfair competition, invasion of commercial rights or right of privacy, deceptive advertising and common law trademark infringement. Plaintiffs, John W. Carson, and Johnny Carson Apparel, Inc., bring these proceedings to enjoin Defendant, Here’s Johnny Portable Toilets, Inc., from using “Here’s Johnny” as a corporate or trade name, or, in connection with, the advertising, offering for sale or lease, and sale or leasing of portable toilets.
