On October 21, 1897, J. E. Ross, the defendant in error, administrator of R. L. Long, deceased, brought his action against the United States Life Insurance Company, the plaintiff in error, in the state district court of Limestone county, Tex., to recover the sum of a policy .of insurance alleged to have been issued to1 the intestate, with legal interest thereon, and 12 per cent, damages, and a reasonable attorney’s fee.
