VOGEL, Circuit Judge.

Willard Barrett, the appellant, is presently confined in the Minnesota State Penitentiary where he is serving a sentence of not less than five nor more than twenty years for the unlawful possession, on or about the 29th day of April, 1958, of a narcotic drug commonly known as marijuana. Concurrently with the Minnesota sentence, the appellant is serving a sentence of fifteen years imposed February 4, 1959, by the United States District Court for the District of Minnesota upon a plea of guilty to Count 1 of an indictment charging the transfer, on or about January 14, 1958,…
