Thomas Gardner brought a suit in case against the Chicago, Lake Shore and Eastern Railway Company to recover damages for personal injuries sustained by him while in its employ. The declaration contains several counts alleging that the defendant negligently failed and neglected to exercise reasonable care in the inspection of certain cars, brakes, appliances and attachments thereof before the plaintiff was required to handle the same, whereby a certain rod and part of the brake system was suffered to be and remain insecurely attached to other parts of said brake system, and that the plaintiff,…
