This cause is before the Supreme Court upon the following certificate from the Honorable Court of Civil Appeals of the Second District:

“The appellee here filed suit in the justice court of Hood County against the appellant for rent, in the sum of $66.00. She further had issued out of the justice court a distress warrant’ and the constable levied upon the barber chairs, tools and other equipment in the barber shop, located in plaintiff’s building.
