FAIRCHILD, Senior Circuit Judge.

Edward Barkauskas was convicted of murder and sentenced to life in prison. After exhausting his state remedies, he petitioned for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. The district court denied it, and Barkauskas appealed. This court reversed and remanded the case to the district court “for evidentiary hearing to determine whether the state violated the Brady rule” (requiring the prosecution to disclose exculpatory materials upon request, Brady v.
