Ramirez, J.), entered February 4, 2016, which, to the extent appealed from as limited by the briefs, denied defendant’s motion for summary judgment dismissing the complaint based on plaintiff’s inability to demonstrate that he suffered a serious injury within the meaning of Insurance Law § 5102 (d), unanimously reversed, on the law, without costs, and the motion granted. The Clerk is directed to enter judgment accordingly.
