PUDLOWSKI, Presiding Judge.

Defendant was convicted of the second degree murder of Mark Walker which arose out of a shooting incident in which defendant also injured his wife, Brenda. On appeal, this court reversed and remanded the murder conviction for a new trial because defendant’s wife testified over his objection in violation of Section 546.260 RSMo 1978. State v. Manning, 657 S.W.2d 301 (Mo.App.1983). Before retrial, defendant and his wife were divorced and she testified in the second trial.
