(dissenting).—I have been unable to agree with the conclusion of the majority as expressed in Judge Harper’s opinion. I believe the legal propositions relied upon and presented by relator correctly present the law of the case. These propositions have been ably and forcefully stated by his counsel in their brief and written argument and so clearly reasoned and supported by authority they should have been sustained.
