Appeal by the defendant, John Laughlin, from an order of the Supreme Court, made at the New York Special Term, and entered in the office of the clerk of the county of New York on the 4th day of October, 1907.

Scott, J.:

The defendant appeals from an order by which the plaintiff and one Charles O. Haas were appointed receivers pendente lite of copartnership property. The material facts are not complicated. In July, 1905, the defendant held a lease of the Lyceum Theatre in Buffalo running to September 1,1906, and a further lease of the same premises running to August 31, 1911, with, an option to extend it to August 31, 1915.
