James Sims sued Richard Creasman, Robert Wilkinson, and Natural Products of Georgia, LLC (“Natural Products”) for breach of a promissory note, fraud, and violation of the Georgia Securities Act (“GSA”), OCGA § 10-5-50. Following a bench trial, the trial court entered a judgment in favor of Sims on the promissory note and ordered Natural Products to pay the balance owed on the note and entered judgment for Wilkinson and Creasman on the other claims because their conduct did not rise to the level of fraud and did not violate the GSA.
