The question to be determined upon this proceeding is as to the construction of the sixth clause of the will of the deceased, in order that the executor ma^ be directed as to what is bequeathed to Frieda Rau Cormier under such clause.

[ 1 ] The said clause reads as follows;

“Sixth. I give and bequeath to my niece Frieda Rau Cormier of Rochester, N. T. Fifty (50) shares of the Capital Stock of the National ,Bank of Rochester ; and in the event of my disposing of said shares before my death, I give and bequeath to her the equivalent of said shares at their par value; and in addition…
