OPINION
HOFFMAN, Senior Judge.
On June 29, 2004, Plaintiffs-Appellants Aaron Scruggs, James Underwood, and Wendell Boddie (collectively "Seruggs") filed a complaint in LaPorte Cireuit Court alleging that they were being incarcerated in violation of the Indiana constitution. The trial court dismissed their complaint pursuant to Ind. Trial Rule 12(b)(6). Seruggs appeals the dismissal of his complaint.
