Appeals, by permission, from two orders of the County Court of Schenectady County (Drago, J), entered January 20, 2010 and March 15, 2010, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment convicting him of the crime of attempted assault in the second degree, without a hearing.
Defendant, a citizen of Guyana, entered this country in 2007. In 2008, he agreed to waive indictment and pleaded guilty to attempted assault in the second degree, following an altercation with his brother. He was sentenced to time served and five years of probation. After federal…
