OPINION

{¶ 1} Plaintiff-appellant, Christopher T. Cicero ("appellant"), appeals the denial of his motion to certify a class, in this action for damages and declaratory and injunctive relief against defendants-appellees, U.S. Four, Inc., W.D. Equipment Rental, Inc., John Basinger, Josh Wellington, and Golding Enterprises, LLC (collectively, "appellees"), for claimed violations of the federal Telephone Consumer Protection Act of 1991 ("TCPA").
