This case is before the Court for review of the decision of the Fifth District Court of Appeal in Rabedeau v. State, 971 So.2d 913 (Fla. 5th DCA 2007). The district court certified that its decision is in direct conflict with the decision of the Second District Court of Appeal in Gisi v. State, 948 So.2d 816 (Fla. 2d DCA 2007). Rabedeau, 971 So.2d at 914. We have jurisdiction. See art. V, § 3(b)(4), Fla. Const.
