ORDER ON DEFENDANTS’ MOTIONS TO DISMISS

GOLD, District Judge.

THIS CAUSE is before the court upon the motions to dismiss (DE # 8, 27) filed by defendants Celebrity Cruises (“Celebrity”), Apollo Ship Chandlers (“Apollo”), and Zenith Shipping Corp. (“Zenith”). 1 Defendant M/V Zenith has not filed a motion to dismiss, and it appears from the record that the individual defendant, Baris Aydin (“Aydin”), never was served with a sum mons and copy of the complaint.
