Appeal from a pro forma order of the Criminal Court of Baltimore sustaining a demurrer to the indictment.

The defendant was indicted in the Criminal Court of Baltimore for a violation of the liquor law. The indictment charges that the act alleged to have constituted the violation of the law was committed on the 30th May, 1897, and the record shows that the indictment was not filed until the 1 ith June, 1898, that is to say, it was filed a few days after the expiration of one year from the commission of the alleged misdemeanor.
