Defendant was indicted by the Monmouth County Grand Jury for misconduct in office committed while he was a police officer of the City of Asbury Park. Two indictments were returned against defendant, one charging him as the sole accused and the other charging him and another police officer as co-defendants. Motions to dismiss both indictments were filed by defendant and denied by the Monmouth County Court.
