WORKMAN, Chief Justice:

This original habeas corpus proceeding was brought to this Court on January 3, 1997, seeking the immediate custodial release of Gordon Lambert, President of the County Commission of McDowell County, and Donald L. Hicks, Sheriff of McDowell County (hereinafter collectively referred to as Rela-tors). On that same day, this Court issued a writ of habeas corpus ad subjiciendum, commanding William Bowman, Administrator of the McDowell County Jail, to release said Relators pending further order of this Court.
