This is an action of tort to recover for personal injuries alleged to have been sustained by the plaintiff while riding in an automobile operated by the defendant. The jury returned á verdict for the plaintiff on the first count based on negligence of the defendant, and for the defendant upon the second count charging her with gross negligence. The defendant excepted to the denial of a motion to direct a verdict for her upon the first count.

In deciding the correctness of this ruling upon the motion we need only consider evidence favorable to the plaintiff from whatever source it came,…
