— Reversing.
The appellant, James D. Hoover, at his home in Lee county, shot and killed Greely Addison o,n November 8, 1919. He was indicted for murder and convicted of manslaughter, his punishment being fixed at confinement for twenty-one years i,n the penitentiary.
The first complaint upon this appeal is that the verdict is not supported by the evidence. This- contention is based upon the theory that defendant by his testimony made out a clear case of self defense, and that the jury could not disregard his evidence since he was the only witness who saw or…
