Appeal by the defendants, Patrick A. Hart and another, from a judgment -of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 17th day of March, 1908, upon the verdict of a jury, and also from an order entered in said clerkls office on the 26th day of March, 1908, denying the defendants’ motion for a new trial made upon the minutes.

Houghton, J.:
The plaintiff was a director of the Baltic Land and Improvement Company which owned a tract of land requiring extensive grading, laying out of streets and sewering for building purposes, negotiations, were entered into with the defendants for doing such work, and resulted in a contract therefor amounting to upwards of $10,000. Plaintiff previous to making the contract had had interviews with defendants respecting such contract and claims that the defendants promised to pay him at least $500 if he should procure for them the contract for the work from his-corporation.
