HARPER, Judge.
Appellant was prosecuted and convicted of an aggravated assault alleged to have been committed on the person of Emma Roper.
We hardly deem it necessary to discuss but one question in the case and that is presented by bill of exceptions No. 9. It appears from the State’s testimony that defendant went into the home of D. A. Boper, his daughter, Miss Emma, being there alone playing an organ. Defendant approached her from behind, threw his arms around her and held her for about five minutes.
