By this action the plaintiff seeks to recover damages for a breach of contract for the sale of certain lands, and also to recover the sum of $1,000, with interest thereon, the same being the advance payment upon the contract of sale. A jury was waived, trial had to the court, and judgment rendered in favor of the plaintiff for $2,693.33. Prom the recitals in the judgment it is very clear that the total sum was made up of an award of $1,600 as damages for the breach of the contract, and $1,000 as the advance payment, with interest thereon. Prom this judgment the defendant has appealed.
