RATLIFF, Chief Judge.

STATEMENT OF THE CASE

Ronald E. Glasscock appeals his conviction of Operating a Motor Vehicle While Intoxicated Causing Death 1, a Class C felony. We affirm.

ISSUES

1. Was the evidence of Glasscock's blood aleohol content (BAC) admitted erroneously because the blood samples were *602destroyed depriving him of an independent blood analysis and denying his rights to due process?
