SAVAGE, District Judge.

This, is an appeal by Acme Maintenance Engineering Company1 from an adverse judgment in an action brought under the Miller Act, 40 U.S.C.A. §§ 270a and 270b to recover the balance alleged to be due on a subcontract entered into with Wunderlich Contracting Company, Curlett Construction Company and Charles H. Tompkins Company2, who were awarded a contract by the United States for the construction of a Veterans Administration hospital at Salt Lake City, Utah.
