NICHOLLS, J.
Plaintiff brings this suit against the United Fruit Company and James J. Legeai, claiming that they are indebted in solido to him in the sum of $10,000, with legal interest thereon. In his petition he alleges that on November 7, 1906, the United Fruit Company had possession of a certain steamship named Bertha, which said defendant used in its business of common carrier, and the other defendant, the said James J.
