This was an action brought by the appellee against the appellant upon a policy of insurance issued by the appellant to the appellee on the 15tli day of September, 1883.

The declaration contained a special count and common counts. In the special count the policy was set out in haee verba. By the policy the defendant insured the appellee from the 15th day of September, 1883, to the 15th day of September, 1884, against loss or damage by fire, to the amount of $1,000 on his stock of furniture, etc. Said property was destroyed by fire on the 31st of January, 1884.
