This case was commenced by the appellee against the appellant to recover damages for injuries sustained while in the service of appellant in the work of mining clay. The charge in the declaration is that the appellant negligently and carelessly maintained and operated its clay pit, so that, while tire appellee was laboring therein, exercising due care and caution, by means of the negligence of appellant a large quantity of earth in said pit fell upon him, etc., by means whereof the face of the appellee was severely crushed and bruised and he was obliged to lay out large sums of money to…
