METZGER, Chief Judge.
This is the second time that this plaintiff has been before this Court on the question of citizenship. In 1941, he filed a petition for a writ of habeas corpus, which was granted and subsequently dismissed. In that proceeding, the petitioner alleged that, upon his return to Honolulu, Hawaii, after a visit to China, he was denied admission to the United States by a Board of Special Inquiry, composed of immigration officers, and that the order of that board had been sustained by the Department of Justice at Washington, D.
