Proceeding initiated in this Court pursuant to Public Officers Law § 36 to remove respondent from the office of Mayor of the Village of Middleburgh.

Petitioner commenced this proceeding to remove respondent from his position as the Mayor of the Village of Middleburgh, Schoharie County. Petitioner claims that respondent improperly administered a buy-out program offered by the Federal Emergency Management Agency by failing to adequately publicize the availability of program funds or to publicly disclose that he had enrolled his own property in the program.
