BACKGROUND

Currently before the Court is the motion to dismiss of defendant John H. Dalton, Secretary of the Navy, against plaintiff Jackie R. Briggs and both parties’ cross-motions for summary judgment. Briggs was a Captain in the Naval Medical Corps Reserve serving on active duty. He was detached for cause from command for “loss of confidence in his ability to command” based on two investigations…
