1Opinion of the Court

LEVIN H. CAMPBELL, Chief Judge.

Donald Look, petitioner-appellant, appeals from the denial of his application for habeas corpus. Convicted of second degree murder in the Massachusetts court, Look complains that he was denied his right to a speedy trial under the sixth and fourteenth amendments to the Constitution of the United States. Look also contends that the state trial court’s failure to instruct the jury on the lesser included offense of manslaughter violated his right to due process under the fourteenth amendment.
