BROWN, District Judge.
This is an action for breach of contract. brought by William Whitman, and others, citizens and residents of New York and of Massachusetts, copartners under the firm narte of William Whitman & Co., against the Namquit Worsted Company, a corporation of Rhode Island.
The case is not free from difficulties. The defendant insists upon the application of the statute of frauds. I am of the opinion that this is not applicable, for the reason that there is no indefiniteness or uncertainty in the contract, and that evidence as to the former course of dealing between the parties,…
