HENDERSON", Judge.
Appellant was convicted of manslaughter, and his punishment assessed at four years in the penitentiary; hence this appeal.
This is the second appeal in this case, appellant having previously been convicted of murder in the second degree, and the case was reversed at the Austin term, 1896, of this court. For a report of the case, see 36 Texas Criminal Reports, 154.
