In 1935, defendant, then 16 years of age, was convicted of two counts of murder and one count of rape and was sentenced to imprisonment for life. (People v. Paiva (1935), 9 Cal.App.2d 10 [48 P.2d 174].) In Deeem ber, 1945, seeking to vacate the judgment of conviction and obtain a new trial, he petitioned the trial court for relief in the nature of a writ of error coram nobis; the relief sought was denied on January 8, 1946, and defendant gave timely notice of appeal and filed notice to prepare the record on appeal.
